What is a Tenancy Lease?

The arrangement by which persons come to occupy premises (house) which is owned by another.

There are two (2) common forms of tenancy: periodic tenancies and fixed-term tenancies.

  • Periodic Tenancy: one which is granted to run from period to period. For example, week to week or month to month. The landlord or his agent can bring this to an end by serving a valid notice to quit.
  • Fixed Term Tenancies:one which is granted for a specific period, for example, three months, six months, or a year. This usually comes to an end when the time runs out.
Starting a Tenancy

The landlord must provide the tenant with:

  1. A copy of the lease within 14 days of it being signed.
  2. A statement of their rights and duties.
  3. The landlord’s full name and address and that of his agent.
  4. Secure, lockable premises that are vacant, clean, and in good repair.

During the Tenancy (living in the house)

Tenants must:

  1. Keep the premises in a reasonably clean and tidy condition. The landlord or agent must be immediately notified of any damages.
  2. Not be a nuisance to others or use the premises for illegal purposes.
  3. Get the landlord’s permission before making any alterations to the premises, sub-let or allow other persons to take over the lease.

Landlord/Agents must:

  1. Maintain the premises in good repair
  2. Not interfere with the tenant’s privacy and use of the premises.
  3. Immediately give the tenants a key if the locks have been changed.

The landlord or their agents cannot enter the premises unless the tenant agrees or if notice is given to the tenant at least 24 hours in advance, stating a time between 8:00 am and 6:00 pm for one of the following reasons:-

  1. To show the house to prospective tenants or buyers.
  2. To value the premises.
  3. To carry out repairs or any obligation under the law.
  4. Where the landlord or agent reasonably suspects that the tenant has not complied with the lease.
  5. In case of EMERGENCY.

If tenants believe that the landlord or agent has either entered the house illegally or damaged the tenant’s property during entry, they may:

  1. Seek assistance at Prices and Consumer Affairs Division
  2. Seek advice/assistance from a solicitor
  3. Visit their nearest Police Station
