1. Question: Are ‘No Refund’ signs legal?

Answer: It may be the business's policy to grant refunds under certain conditions. In keeping with our consumer laws, once an item is defective, the consumer has the right to seek compensation.

2. Question: Why should I keep my receipt?

Answer: A receipt is proof of purchase needed to return an item

3. Question: How long can a consumer keep an item in his possession before it can be returned to the store?

Answer: This depends on the store policy. Some stores give one to two weeks for returns.

4. Question: Does the legislation regulate Online Businesses?

Answer: If the business operations is in Antigua and Barbuda, it would be governed under the laws of Antigua and Barbuda.

5. Question: Why can’t I get my deposit back?

Answer: Generally, a deposit is non-refundable. Consumers should be sure they want the product or service before making a deposit. If you change your mind, you are not, by law, entitled to get your money back. Also, you may be unable to get your deposit back if you cancel something you paid a deposit for or break an agreement. Ask what the conditions are before you make a deposit, and only put down the minimum amount required.

6. Question: How can I get my money back?

Answer: Consumers may be able to obtain a refund if they receive defective goods incorrect goods, unsatisfactory services or broken agreements. In some instances, another redress option (repair, exchange or credit note) may be offered. The sales receipt is needed.

7. Question: How do I make a complaint?

Answer: The first step is to contact the trader or service provider and clearly present your problem. Complaining in person helps to force the issue, but it is not always necessary. You can also complain by phone, or in writing by email or mail. Go to the trader to return the purchase or if you need to meet with someone to examine the item and receipt. Should your attempts to contact the trader or service provider be ignored, they refuse to help you, or you are unhappy with the outcome, contact the Division.

8. Question: Can I use expired goods?

Answer: Generally, it is unsafe to use expired goods. After the expiration date has passed the quality of the goods cannot be guaranteed.

9. Question: Do consumers have rights?

Answer: We believe consumers have a right to access quality goods and services, to be treated fairly, and to be offered fair compensation if things go wrong.

10. Question: After purchasing an item, it stops working within a week. What should I do?

Answer: Do not attempt to fix it. Return the item to the place of purchase immediately to seek redress. If you are unable to obtain redress, contact the division.
